Technical assistance for the implementation of public procurement reforms, with an emphasis on increasing competition in the public procurement market
Public procurement is a strategic lever for supporting competition and development. The project served identify and select the most important reforms to be implemented to increase the efficiency and effectiveness of the public procurement system, by reducing the number of single bids and the proportion of negotiated procedures without publication.
Context
The public procurement system in Slovenia has been facing major challenges related to the type of procedures used (open, low value and negotiated) and number of bidders in the public procurement system. A key success factor is to achieve a commitment and engagement of stakeholders to select reforms to be implemented which will have a long-term positive impact, as well as to contribute to the implementation of the national Resilience and Recovery Plan (RRP). Slovenia obliged to reduce the share negotiated procedures for 12% until 2024 and submit a report with assessment and recommendations by Q2 2022.
Support delivered
A comprehensive analysis of Slovenian public procurement system with an emphasis on negotiated procedures and single-bid procedures was conducted. Gaps were identified and analysed, and areas of improvement defined. Recommendations were suggested, according to the Slovenian procurement and market context and best EU practices and Action plan prepared. Stakeholders were involved in the process through surveys, interviews, online feedback process and consultation workshops. The project was delivered from April to October 2022.
Results achieved
The project resulted with a Recommendations report and Action plan to increase a competition and reduce the number of negotiated procedures without prior publication. Close cooperation with the beneficiary and engagement of stakeholders resulted in the tailor-made recommendations and achievable actions. The project has facilitated considerations and proposal of changes to the Public Procurement Act which shall lead to decrease in the number of negotiated procedures without prior publication and increase the competition. Within interviews and quality discussions during the project, main shortcomings were revealed in the beneficiaries` capacities.
